NYC DOB Violation Clearance

Architect-Led Assistance for Clearing NYC DOB Violations

Apartment Renovation NYC’s team provides violation clearance services for Owners dealing with open New York City Department of Buildings (DOB) violations and OATH summonses. We begin by reviewing the property record and cited condition to determine what actually needs to happen before the violation can be resolved.

Depending on the violation, this may involve an existing-conditions review, architectural drawings, legalization of prior work, DOB filings, permits, corrective construction, inspections, or documentation showing that the condition has been corrected. The objective is not simply to submit paperwork. It is to establish a clear path from the existing violation to an accepted correction in the DOB record.

Common Problems Owners Encounter With DOB Violations

Work Was Performed Without the Required Permit

One of the more complicated situations is a violation involving work performed without a required permit. This may involve apartment partitions, plumbing work, structural modifications, mechanical work, or other alterations.

The existing work cannot automatically be legalized simply because it has already been built. An Architect may first need to document the condition and determine whether it complies with applicable code and other requirements. If it does not, corrective work may be necessary before the violation can be cleared.

The Penalty Was Paid, but the Violation Is Still Open

Owners sometimes assume that paying an OATH penalty closes the violation. It does not necessarily do so. DOB states that a summons can remain open until the violating condition is corrected and acceptable proof of correction is submitted.

An Old Violation Is Discovered During a Sale, Refinance, or Renovation

Violations sometimes remain on a property record for years before an Owner becomes aware of them. They may surface during title review, refinancing, due diligence, or planning for a new renovation.

DOB notes that open violations are public property information and can interfere with a sale or refinancing. Active DOB violations can also prevent issuance of a new or amended Certificate of Occupancy or Letter of Completion.

The Owner Does Not Know What Actually Needs to Be Corrected

A violation number identifies a compliance problem, but it does not always provide an Owner with a complete solution. Existing conditions, previous filings, approved drawings, permits, and the current configuration may need to be reviewed together by an Architect.

This is where architectural assessment becomes important. Before a contractor is asked to price corrective construction, the required scope should be understood and documented between an Owner and Architect.

How We Approach Violation Clearance Differently

Our process is Architect-led. We start by reviewing the violation, available DOB records, and the relevant existing conditions. From there, we determine whether the matter requires corrective work and establish the appropriate sequence.

Some of typical steps:

DOB Record Review → Existing Conditions → Feasibility & Code Review → Architectural Drawings → DOB Filing & Permits → Defined Corrective Scope → Contractor Pricing → Corrective Work → Inspections & Documentation → Violation Closeout

This substantially benefits the Owner because the contractor is not being asked to determine an architectural or code-compliance solution before the project has been defined.

If drawings or permits are required, they become part of the corrective strategy. If construction is required, contractors can price a defined scope. If additional consultants or licensed trades are required, they can be identified by our team.

Apartment Renovation NYC also provides in-house DOB expediting, helping maintain continuity between the architectural documents, DOB comments, revisions, permits, and closeout process.

How Much Does Permitting for Violation Clearance Cost?

There is no single DOB processing fee that applies to every DOB violation clearing process. DOB filing fees are calculated according to the type and scope of the application and information entered into DOB NOW.

Violation clearance may involve costs such as:

  • Apartment Renovation NYC’s architectural and expediting fees
  • DOB application processing and permit fees
  • OATH penalties or applicable DOB civil penalties
  • Engineer or other consultant fees, where required
  • Licensed contractor or trade costs for corrective work
  • Progress or Special Inspection services, where applicable

Work-without-permit violations can carry separate DOB civil penalties, and those penalties generally must be paid or appropriately waived before the related Certificate of Correction can be approved. For that reason, we review the violation before establishing our professional-services proposal rather than publishing a generic cost that may not apply to your property.

How Long Does DOB Violation Clearance Take?

The timeline depends primarily on what is required to correct the violation. A matter involving documentation of an already-corrected condition may follow a substantially shorter path than a violation requiring architectural drawings, DOB filing for permit, plan review, permits issuance, corrective construction, inspections, and a Certificate of Correction.

Agency review times, contractor scheduling, required consultants, existing building conditions, and whether the initial correction submission is accepted can also affect the schedule.

For OATH summonses, DOB requires the violating condition to be corrected and certified as corrected. If a Certificate of Correction submission is disapproved, the documentation must be corrected and resubmitted.

We therefore establish the likely sequence after reviewing the specific violation rather than promising an unsupported clearance date.

NYC DOB Violation Clearance FAQs

How do I clear a DOB violation in NYC?

The process depends on the violation. Generally, the cited condition must be corrected and proof of correction provided to the appropriate DOB unit. Permits, drawings, inspections, penalties, or other documentation may also be required depending on the condition.

Do I need an Architect to clear a DOB violation?

Most times, yes. Architectural services are particularly relevant when the correction involves building alterations, code analysis, architectural drawings, legalization of previous work, DOB filings, or permitted corrective construction.

Can I clear a violation for work completed before I owned the apartment?

Potentially, yes. The first step is to review the violation, available DOB records, and the current physical condition. Older violations may require additional investigation because the original work, drawings, permits, or documentation may be incomplete.

Does paying the fine clear the violation?

Not necessarily. DOB states that an OATH summons may remain open even after the OATH penalty has been paid until acceptable proof is submitted showing that the violating condition has been corrected.

What is a Certificate of Correction?

For an OATH summons, a Certificate of Correction is the process used to demonstrate to DOB that the cited condition has been corrected. DOB currently handles these requests through DOB NOW: Safety.

Should I address an old violation if I am not currently renovating?

It is generally useful to understand an open violation before it becomes connected to a renovation, sale, refinancing, or other deadline. The appropriate urgency depends on the violation. Class 1 OATH summonses are Immediately Hazardous and require immediate correction.

Can you legalize work performed without a permit?

Yes, short answer. Where legalization is feasible, we can assess the existing condition and determine the architectural and DOB filing requirements. Some existing work can require modification before it can be approved. Read more about Legalization of Work Without a Permit.

Can violation clearance be coordinated with an apartment renovation?

Yes, short answer. When an Owner is already planning a renovation, an existing violation should be reviewed during the existing-conditions and feasibility phases so that the corrective work and proposed renovation can be coordinated rather than treated as unrelated construction.
